Contemporary moral philosophy rightly gives an important place not only to theories of right action, but to the nature and value of our interpersonal moral attitudes, including such reactions as resentment, admiration and forgiveness. Whilst these concerns have always been of interest to theologians and psychologists, their philosophical importance partly derives from wider concerns about the nature of persons. The recent resurgence, for instance, of retributivist theories of punishment, which are finding favour among many philosophical writers, largely bases itself on (...) the idea that a range of ‘participant reactive attitudes’ is both socially indispensable and morally legitimate. This book offer a sustained and vigorous defence of free expression and objective enquiry situated in the context of the current culture wars. In the spirit of J. S. Mill, it investigates objections to free expression and enquiry in relation to harm and offence, reaching classically liberal conclusions and with particular reference to recent controversies on university campuses. While accepting that the concept of harm is broader than than merely physical harm, the book implicitly offers a critique of objections to (...) free speech and enquiry that are based on certain current understandings of power and privilege. In exploring and rejecting arguments against the possibility of obtaining objective truth, the book navigates hotly contested fields of contemporary debate, including feminism and identity politics. It challenges the dogma of social constructionism and examines current notions of identity, arguing that a case for fairness can be made without appealing to them. Offering a qualified endorsement of friendship between ideological opponents, the book highlights common obstacles to civil and rational discussion, concluding with a rational, moral and broadly spiritual solution to the cultural combat that monopolises present-day society. In this engaged and engaging survey Piers Benn examines the major currents of ethical theory, concentrating on sound reasoning about morality. Benn's account offers a qualified defence of Aristotelian virtue theory, while bringing out what is distinctive and valuable in a broad range of approaches, such as those of Kant and the Utilitarians. His examples emphasize the ordinary choices of everyday life - gossip, friendship, honesty, sexual relations, work, and self-realization.

‘Twelve Step' recovery programmes such as Alcoholics Anonymous teach that an alcoholic, or other addict, has a disease, and needs to accept that she is ‘powerless' over her addiction before recovery can begin. However, the disease model of addiction has been criticised on the grounds that some addicts recover without external intervention. This critique is questionable, not because such recovery does not occur, but because many genuine diseases are self-limiting. However, the disease model is better criticised on other grounds. Central (...) here is the idea of powerlessness. This article explores various supposed instances of powerlessness, including that induced by extreme fear, provocation and obsessive-compulsive disorder. It is argued that while addiction is a genuine phenomenon, it is strictly inaccurate to describe it as a lack of power. However, there is a deeper sense in which the autonomy of addicts is compromised, although this does not show that addiction is a disease. (shrink)

He takes as his starting point some common ground between his views and my own, especially about the importance of Strawsonian participant reactive attitudes to our understanding of psychopathy. But he proceeds to claim that the (...) distinguishing feature of psychopaths is not their lack of such attitudes but their inability to understand how relationships are affected by their behavior—and indeed their inability, in some sense, to understand interpersonal relationships at all. He also takes me to task for claiming that the participant reactive attitudes (PRAs)—presumably he includes things like resentment, indignation, gratitude, and so on—are essentially communicative. For him, this is too strong a claim, because we can imagine cases when such attitudes are expressed, but without any communicative purpose.On the latter point, I concede that people often do express PRAs even though they know such expression will have no effect on those whose behavior or attitudes gave rise to them. Different things can explain this lack of effect. For example, imagine a normally responsive person who obstinately fails to see that a certain judgment applies to him or her in a particular case. Take a woman who repeatedly expresses frustration and anger toward her husband for failing to do any domestic chores, but without having the slightest effect on him. Eventually her expressions of anger serve more as an emotional release than as an attempt to get him to change. As in Ciocchetti's example of Mary's reaction to her calls not being returned, she gives up in the end, expressing anger but without any hope of getting through to the other person.But there is another possible explanation for her anger: suppose the husband's failure to contribute to the housework does not arise from his inability to respond to moral claims upon him, but because he thinks he is already doing his duty by being the sole wage earner, and is quite intransigent about this. In that case, the woman might still see him, in general, as a proper object of her PRAs. She sees his fault as local rather than general; a failure, or perhaps even an inability, to think properly about this particular issue rather than about moral demands in general. She might regard her angry outbursts as justified, not because they will have any effect on him now, [End Page 189] but because they are a proper participant response to some earlier failure, which he was then able to do something about—maybe he neglected to think properly about fairness when forming his moral outlook.Compare this case, though, with someone who just does not understand the nature of relationships and the obligations they impose. This is the sort of case Ciocchetti has in mind. Anger is, on his account, understandable, not because it is meant to communicate anything, but because it is "an expression with no further aim at all" (2003, p. 178). On this point, I agree that people sometimes do express anger (or other emotions) without trying to induce a response in someone. At the same time, there is a significant difference between times when we do hope to elicit an appropriate participant response like shame, and times when we do not. When we express such attitudes without any hope of a participant response, we miss something that is, if not essential to, at least typical of such expressions. Getting angry with the neighbor's aggressive dog or scrounging cat is understandable, but it is simply not the same kind of thing as getting angry with a normal, rational adult. The typical case, maybe the necessarily typical case, is when we experience or express such emotions toward, or at least concerning, beings capable of PRAs—and, again typically if not always, such beings are capable of understanding when and why the PRAs of others are directed toward them.But the thrust of Ciocchetti's paper lies not... This article offers a qualified defence of the view that there is a moral difference between telling lies to one's patients, and deceiving them without lying. However, I take issue with certain arguments offered by Jennifer Jackson in support of the same conclusion. In particular, I challenge her claim that to deny that there is such a moral difference makes sense only within a utilitarian framework, and I cast doubt on the aptness of some of her examples of non-lying deception. But I argue that lies have a greater tendency to damage trust than does non-lying deception, and suggest that since many doctors do believe there is a moral boundary between the two types of deception, encouraging them to violate that boundary may have adverse general effects on their moral sensibilities. This paper attempts to clarify what is, and is not, meant by claiming that special moral considerations apply to sexual behaviour that cannot apply to other areas of life. It then poses the problem by reference to virtue ethics, asking whether there are any virtues or vices specific to sex, which go beyond general considerations like justice and benevolence. This leads to a mostly sympathetic treatment of Scruton’s Aristotelian derivation of sexual morality, which stresses how some behaviour and fantasies are (...) debarred by a stable disposition to seek erotic flourishing. However, doubts are raised about some of the supposed implications of this account, and it is suggested that a better way to understand the moral distinctness of sex is to focus on the goods, rather than the evils, that arise uniquely in the erotic sphere. In a recent issue of Think , Brenda Watson suggested that atheism is also a ‘faith position’. Here, Piers Benn looks more closely at this often-made suggestion.

It has often been thought that there is a special difficulty involved in conceiving of one’s own death. It is easy to think that, while one can easily conceive of, and acknowledge, the death of another person, one cannot ever conceive of what it is for oneself to die. Various things have been inferred from this. The most extreme inference is that one’s own death, or, to be more precise, one’s own non-existence, is actually impossible, since what is inconceivable is (...) impossible. One might also try to infer that one’s existence had no beginning either, although this view is less popular. But even if one does not embrace such extravagant conclusions, conceiving of one’s own ceasing-to-be can easily seem to present a great difficulty. Some existentialist writers and theologians influenced by existentialism have made great play of the supposed mystery. Paul Edwards writes of the temptation to think of death as “existence in a dark, impenetrable abode,” as if non-existence, or the absence of experience, were in fact a peculiar kind of experience which presents us with a great mystery. On this view, even when we conceive of the death of others, we cannot grasp the essential mystery. As Heidegger puts it: “And even if, by thus Being there alongside, it were possible and feasible for us to make plain to ourselves ‘psychologically’ the dying of Others, this would by no means let us grasp the way-to-be which we would then have in mind—namely, coming-to-an-end. We are asking about the ontological meaning of the dying of the person who dies, as a possibility-of-Being which belongs to his Being. We are not asking about the way in which the deceased has Dasein-with or is still-a-Dasein with those who are left behind.” One might make a similar point as follows: I cannot observe my own passing from the world, and observe the world’s continued existence. Once I cease to exist, then “my world” finishes. Wittgenstein writes in the Tractatus: “The world is my world”—and while there is a way in which this is obviously false, it captures much of the intuition under discussion. (shrink)

This paper discusses the moral responsibility of psychopaths for their anti-social actions. Starting from P. F. Strawson's discussion of our participant reactive attitudes, which stresses their indispensability for meaningful human relations, the paper contrasts a variety of "normal" wrongdoers with psychopaths. It suggests that the latter are often seriously deficient in their capacity to entertain these attitudes, and that their resulting lack of proper self-evaluation may explain both their callousness and their imprudence. It is then argued that only creatures able (...) to entertain participant reactive attitudes can be proper objects of those attitudes, since these reactions have a communicative core whose expression has a point only in a shared moral world. For this reason, if psychopaths are incapable of moral understanding, they may not be proper targets of anger and resentment. This, however, may have an illiberal implication, in possibly excluding psychopaths from possessing certain rights. (shrink)

This article analyses some familiar arguments both for, and against, same-sex civil marriage. I argue that it is not enough to defend gay marriage by a simple appeal to equality, unless one addresses the view that same-sex marriage would be contrary to the objective nature and purpose of marriage. I illustrate the ways in which a stand-off is reached in discussions of this particular matter. I also suggest that there is a mystery about what the from a faithful relationship to (...) marriage amounts to, but that part of the answer is that marriage embodies a state-recognized social transition. This is underpinned by the interest that society has in marriage, largely owing to its facilitating a stable environment for children. However, I suggest that marriage also properly functions as a way to uphold commitment and love, and conclude that that there is no good reason not to uphold those things in same-sex relationships. But I concede that religious organisations with theological objections to same-sex marriage should not be obliged to conduct gay weddings. (shrink)

He never went through with it but continued to experience an intense desire to amputate his healthy limb for the following fifty-plus years. Described for the first time in 1977 as apotemnophilia, BIID was originally thought to be a psychological disorder characterized by sexual arousal associated with the desire to be an amputee. However, it was renamed when Dr. Michael First, a professor of clinical psychiatry at Columbia University, proposed that the primary motivation behind the condition was an issue of identity rather than of sexual desire.2 This proposal is controversial.3 Despite much [End Page 1003] debate, BIID was not included in the most recent edition of the Diagnostic and Statistical Manual of Mental Disorders (DSM-5), which was published on May 18, 2013.In this essay, we will consider the ethics of surgical interventions for BIID and Gender Dysphoria (GD).4 We begin with a discussion of the principle of totality that distinguishes ethical from unethical modifications of the body. We will refer specifically to the latter category of surgical interventions as "mutilations," though the Catholic moral tradition's use of the term is itself ambiguous.5 This is followed by an extensive moral discussion of (1) amputations of healthy limbs for patients struggling with BIID and (2) sex reassignment surgeries for those who identify themselves as transgender persons. I will propose that an ethical argument can be made to justify the former but not the latter.The Principle of TotalityBecause of the goodness of the human body, its integrity is a good that has to be protected and preserved. The ethical principle that is used to judge the morality of bodily interventions that impinge upon this bodily integrity is the principle of totality.6 It was articulated by St. Thomas Aquinas in his Summa theologiae as follows:Since a member is part of the whole human body, it is for the sake of the whole, as the imperfect for the perfect. Hence a member of the human body is to be disposed of according as it is expedient for the body.... If, however, the member be decayed and therefore a source of corruption to the whole body, then it is lawful with the consent [End Page 1004] of the owner of the member, to cut away the member for the welfare of the whole body.7Over the centuries, Catholic moral theologians appealed to the principle of totality to justify three different scenarios that involved the sacrifice of a bodily organ for the sake of the whole human organism. The first case involves a diseased organ that has to be removed to save the life of the soldier wounded on the battlefield—say a gangrenous, decaying limb as in the example of Aquinas. The second case involves the healthy foot of a man who is trapped on a railroad track that has to be amputated to save his life from a collision with a train, and the third case involves the healthy limb of an individual that has to be amputated in response to a tyrant who orders him to cut off his own hand or lose his head to the executioners instead. In these cases, the sacrifice of the part would be morally permitted as a necessary means of preserving the life of the individual. As Fr. Gerald Kelly, S.J., points out, this final case is particularly significant because it involves a healthy limb whose very presence—and not its diseased or trapped condition—becomes a source of vital harm for the organism.8How does one justify the principle of totality? Ideas do work thus, of course, immediately or remotely; but they work indefinitely inside the mental world also.(James, 1978: 267)Thus wrote an exasperated William James in The Meaning of Truth in 1910, attempting to refute the persistent misunderstanding of classical American pragmatism as being some form of reductive and technocratic epistemological capitalism. A century on and the misunderstandings rather depressingly continue in new contexts, most notably environmental philosophy, and we must ask “Why?” I suspect that this question has several interconnected answers: the popular non-philosophical associations of the word “pragmatism”; the mistaken tendency to equate pragmatism with runaway subjectivism; poorly informed impressions of the pragmatist criteria of “success” [End Page 123] and “workability”; and the misguided common assumptions, popularized in early environmental ethics work, that pragmatist schemes have no room for noninstrumental values (Leiss 1972; Rolston 1989; Hargrove 1989). The last of these continues despite scholarly refutations (Weston 1992; Minteer 2001; McDonald 2004; Stephens 2009 and 2012), and it is possible that a deeper reason for this obdurate resistance to pragmatist persuasion may lie in the philosophical history of persuasiveness itself. For as Shane Ralston observes in this book’s introduction, there is an intimate relationship between pragmatism and rhetoric, one which clashed with emergent Platonic ideas of truth during the very birth pangs of Western philosophy and may thus have led both to “a philosophical prejudice that rhetorical persuasion is inferior to philosophical logic” (xiv) and a related awareness that “the democratic spirit of rhetoric and its moorings in commonsense, everyday experience make it especially compatible with pragmatism” (xiv). Thus the mistaken tendency to equate philosophical pragmatism with the crassly opportunistic or the crudely populist, and the persistent failure to register pragmatist philosophy’s subtleties may well both have their roots in antique rivalries—Plato’s contrast of truth to mere popular opinion and his related condemnation of the Sophist rhetoricians. Ralston’s response to this problem is first to sensibly orientate his pragmatism to the philosophically sophisticated end of the spectrum and then employ it to enrich contemporary theory of rhetoric. He then attempts to demonstrate the potential of the new pragmatic rhetoric in a series of studies of particular areas of environ-mentalist contestation.Ralston’s variety of pragmatism is one that tries to largely eschew the generic popular associations of the word, and he notes the sensible distinction between the classical or paleo-pragmatism of Peirce, James, and Dewey as against the contemporary neo-pragmatism of Rorty and others. Though Ralston claims to “combine elements of both classical pragmatism and neo-pragmatism to highlight how pragmatism improves discursive practice” (xvii), in practice the most significant influence on the work appears to be Dewey, and this paleo-pragmatist reviewer was pleased to see that Ralston tries to avoid the tendency to play up the managerialist aspects of pragmatism in favor of “philosophical pragmatism’s other rich resources” such as “its fallibilism, experimentalism, and meliorism” (xxv). The aim of connecting up these pragmatist resources to rhetoric is to show that “a deeply pragmatic rhetoric, once introduced into environmental communication, has the potential to transform the way environmental activists speak about their [End Page 124] methods and goals, moving them toward what I call a rhetoric of eco-justice” (xxx), a rhetoric which can displace the current focus on value theory because it “offers a superior route toward advancing an agenda that preserves the natural environment and promotes ecological justice” (xxxi).In attempting to demonstrate these declared goals, the main body of the book is organized into five chapters. In this paper, I argue that the responsibility-affecting defect of psychopaths is their incapacity for responding to acts within relationships. I begin with Piers Benn's account of psychopaths as incapable of forming participant reactive attitudes. Benn argues that participant reactive attitudes are essentially communicative and the ability to form and understand participant reactive attitudes is crucial to being a member of the moral community. Against Benn, I argue, though participant reactive attitudes can be communicative, they are (...) not essentially communicative. Instead, they can be simply expressive. Therefore, we must consider psychopaths members of the moral community, in Benn’s sense; however, psychopaths fail to interpret their actions as part of relationships. This inability renders punishment, as an attempt to rectify wrong relationships, inappropriate for psychopaths. Psychopaths have diminished responsibility, insofar as they have forfeited some rights by committing an offense, but are not appropriate candidates for punishment because they cannot understand its significance. According to the fairness argument, same-sex marriage must be permitted because without it there would not be equal treatment for homosexuals and heterosexuals. In, Piers Benn holds that the argument does eventually deliver this conclusion, but not as readily as intuitively appears. He concludes that some conservative points against same-sex marriage achieve at least a stand-off from the point of view of the argument. I argue that he accords the conservative points much more significance than they actually deserve (...) and misconstrues the metaphysical dimension that is an important part of how the fairness argument operates. Following the well-publicised case of Dr Sarah Benn, the former General Practioner (GP) who was suspended from the UK medical register earlier this year for breaching injunctions in order to peacefully protest climate change,1 uncertainty and wider discourse has persisted about the extent to which doctors can be involved in protests without risking regulatory action. In response to this uncertainty, in July the General Medical Council (GMC) published an explanation of how it manages concerns about doctors’ actions as part (...) of protests and activism. It includes the statement that they are bound by law to refer any conviction resulting in a custodial sentence directly to a Medical Practioners Tribunal Service (MPTS) hearing.2 They also state that the nature of the protest does not impact their consideration of whether there was a serious breach of professional standards or a risk to public protection.2 The move to clarify the GMC’s position has been cautiously welcomed by the UK Health Alliance on Climate Change but with criticisms that important questions remain unanswered, such as the GMC’s rationale for determining that public confidence in doctors is harmed by convictions arising from environmental activism.3 Interest in this issue shows little sign of fading, as regulatory action continues to be taken against climate activist doctors. We present a theoretical framework bearing on the evolution of written communication. We analyze writing as a special kind of graphic code. Like languages, graphic codes consist of stable, conventional mappings between symbols and meanings, but (unlike spoken or signed languages) their symbols consist of enduring images. This gives them the unique capacity to transmit information in one go across time and space. Yet this capacity usually remains quite unexploited, because most graphic codes are insufficiently informative. They may only be (...) used for mnemonic purposes or as props for oral communication in real-time encounters. Writing systems, unlike other graphic codes, work by encoding a natural language. This allows them to support asynchronous communication in a more powerful and versatile way than any other graphic code. Yet, writing systems will not automatically unlock the capacity to communicate asynchronously. We argue that this capacity is a rarity in non-literate societies, and not so frequent even in literate ones. Asynchronous communication is intrinsically inefficient because asynchrony constrains the amount of information that the interlocutors share and limits possibilities for repair. This would explain why synchronous, face-to-face communication always fosters the development of sophisticated codes (natural languages), but similar codes for asynchronous communication evolve with more difficulties. It also implies that writing cannot have evolved, at first, for supporting asynchronous communication. (shrink)
